Court proceeding ended in dramatic fashion after a juror in Notre Dame football coach Charlie Weis’ malpractice trial fainted before the deliberations could begin. The two accused doctors rushed to the assistance of the fainted juror. The judge then called a mistrial after another juror admitted that he would not be able to put the thought of the two doctors’ help for the fallen juror out of his mind.
Weis was in court attempting to sue two Massachusetts surgeons for what he claims was malpractice during and after a botched gastric bypass surgery while Weis was an assistant for the New England Patriots. Famed Pats QB Tom Brady was a witness in the trial.
Do you smell the plot of a prime time law drama? Well I do. I also smell a sound defeat for Mr. Weis, who, apparently, is going to fight an uphill battle against the doctors. It is very hard to win a malpractice suit against doctors, especially in New England, and especially when you aren’t a very sympathetic character, being that you have, arguably, the most prestigious coaching job in America. This is not to say that Weis’ argument isn’t just- it might very well be- but he will probably not win in court.
