The Charlie Weis malpractice lawsuit has restarted after the first one ended in a mistrial. As you might recall, Weis was suing two New England doctors for malpractice after what he called a botched gastric bypass surgery. After the surgery, Weis began to bleed internally and was bedridden, in and out of comma, and was told he was near-death. The surgeons then reopened Weis to repair tissue where internal bleeding had gotten worse than expected. Weis and the doctors had been near the end of the first trial when a juror collapsed during some testimony, the doctors rushed to the aid of the juror, the judge declared a mistrial, and the whole trial has begun again.
It is hard to say whether or not Weis will actually win this case, though history is not on his side, apparently. Traditionally it is had to convict on mistrials, even in a case where a patient dies. Weis not only got better, he also lost almost 100 pounds and- possibly as a result- got one of the best coaching jobs in the nation.
